Definitions

Terms used in this Agreement have the same meanings as defined in the Commt.co Terms of Usage, Privacy Policy, GDPR Compliance Statement and Distance Sales Agreement.

Service Delivery
  • Access: Upon successful subscription and payment verification, the Consumer will be granted access to the Commt.co services, including but not limited to the web application, dashboard, and SDKs, as per the subscribed plan.
  • Availability: We commit to ensuring the availability of the services as described in the subscription plan, barring maintenance periods, technical issues beyond our control, and other exceptions outlined in our Terms of Use.
Cancellation and Return Terms
  • Cancellation Right: Consumers have the right to cancel their subscription and terminate the service agreement within a specified period, as detailed in the Distance Sales Agreement, without needing to provide a reason.
  • Service Return: Given the digital nature of our services, a 'return' equates to the termination of access to our services and the deletion of the Consumer's account and data, in accordance with our Privacy Policy.
Refund Policy
  • Eligibility for Refunds: Refunds are available under the following conditions:
    • Within the "cooling-off" period: Full refund of the subscription fee if the cancellation is made within the legally specified cooling-off period, typically 14 days after subscription commencement, unless services have been fully utilized.
    • Service not as described: If the services provided do not match the description provided at the time of subscription, or if there are technical issues that prevent the basic use of the service and cannot be resolved within a reasonable timeframe.
  • Processing Refunds: Eligible refunds will be processed to the original payment method within 14 days of the cancellation request. This period may vary depending on the payment provider.
  • Non-refundable Circumstances: No refunds will be provided for periods where the service was utilized without reported issues or beyond the cooling-off period unless specifically covered by a separate satisfaction guarantee.
Modifications to the Agreement

Commt.co reserves the right to modify these Return Terms, Delivery, and Refund Agreement terms. Any changes will be communicated to the Consumer in advance and will take effect from the date of the next subscription renewal.

Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Commt.co operates. Disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of these courts.
